Terms and Conditions

The following terms and conditions apply to all website development/design services provided by MWebAtWork to the Client.

The meaning of the words used.

Work or Job refers building of the website or a task to do with the website, server or project.
The words "Client" or "You" refers to the person reading the terms or taking responsibility for the payment and or handling the project at hand.

Section 1
Acceptance

It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.

Please read these terms and conditions carefully. Any purchase or use of our services implies that you have read and accepted our terms and conditions.

Section 2
Completion 

After completion of the Website. There's a 7-day window to make and alert us of corrections needed on the website (correction involves spelling mistakes, error in content text and inactive content like buttons or incorrect hyperlinks. It does not include changes to the design. Colour or functionality. This will be classified as a modification and is there for chargeable. See section 3.1 for details. 

Section 3
Charges

3.1 After completion of the project any change needed to be made on the site is subjected to a £10 to £40 per hour charge. The cost of labour per hour depends on the task and our discretion and will be made upon the client receiving the quotation or invoice and agreeing to it. If a job is complicated or may take several hours then a flat fee may be arranged between you and MWebsAtWork.  

3.2 Estimate of the project is sent to you before work is started, the cost of the work may vary due to changes made by the Client or unforeseen issues, if that is the case then the client is made aware of this and the change is either reflected in the main invoice or a separate one.

3.3 Estimates are based on initial discussion made with the client. The work content may change and the size of the project or workload may also be affected

Section 4
Media and Textual content

4.1 Clients are responsible for supplying the Media content needed for the website. The Images, Videos, PDF, Vector or any other media needs to be giving to MWebsAtWork in the highest quality possible. If media quality is low or not up to standards then the site may not look as professional or attractive as can be which will not be a responsibility of MWebsAtWork or outsourced companies.

4.2 The text content needed on the site and articles or instructions on obtaining them (I.e from current website) needs to be provided to MWebsAtWork, It is not our job to make up content for the website or come up with slogans or your business needs. If there are grammatical errors or spelling mistakes then this can be rectified, see Section 3.1 in this Terms and Condition for details.

Section 5
Client Review

MWebsAtWork will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies MWebsAtWork otherwise within ten (7) days of the date the materials are made available to the Client.

Section 6
Additional Expenses

Client agrees to reimburse MWebsAtWork for any additional expenses necessary for the completion of the work. Examples would be a purchase of special fonts, stock photography etc. A separate invoice may be created.

Section 7
Web Browsers

MWebsAtWork makes every effort to ensure websites are designed to be viewed by the majority of visitors. Each Website is designed to work with the most popular current browsers (e.g. Safari, Firefox, Internet Explorer 8 & 9, Google Chrome, etc.).  

Client agrees that MwebsAtWork cannot guarantee correct functionality with all browser software across different operating systems. MWebsAtWork cannot accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website have been designed and handed over to the Client. As such, MWebsAtWork reserves the right to quote for any work involved in changing the website design or website code for it to work with updated browser software.

Section 8
Wordpress Update

Clients are responsible for updating the backend system with Wordpress. If the Client needs an assistant in updating Wordpress, they can contact MWebsAtWork. They may be a fee attached to the work. MWebsAtWork will not be responsible if the update to the Wordpress Backend or Server causes any issues with plugin or website functionality.

Section 9
Refunds and cancellation 

If a website project is cancelled within 7 days or more than 5 hours of work carried out into the project then there will be a cancellation fee of £50 minimum. If the project has had significant work done and has cost the company expenses or hours of work greater than 5 hours, then a cancellation fee of what MWebsAtWork feel is reasonable will then be calculated. So if you feel for any reason the project should not be started or you are not ready then do not give to go head to start the job.

Section 10
Indemnity

All MWebsAtWork services may be used for lawful purposes only. You agree to indemnify and hold MWebsAtWork harmless from any claims resulting from your use of our service that damages you or any other party.

Section 11
Copyright

The Client retains the copyright to data, files and graphic logos provided by the Client, and grants MWebsAtWork the rights to publish and use such material. The Client must obtain permission and rights to use any information or files that are copyrighted by a third party. The Client is further responsible for granting MWebsAtWork permission and rights for use of the same and agrees to indemnify and hold harmless MWebsAtWork from any and all claims resulting from the Client's negligence or inability to obtain proper copyright permissions. A contract for website design and/or placement shall be regarded as a guarantee by the Client to MWebsAtWork that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested.

Section 12
Governing Law

This Agreement shall be governed by English Law.

Section 13
Liability

MWebsAtWork hereby excludes itself, its Employees and or Agents from all and any liability from:
• Loss or damage caused by any inaccuracy;
• Loss or damage caused by omission;
• Loss or damage caused by delay or error, whether the result of negligence or other cause in the production of the website;
• Loss or damage to clients' artwork/photos, supplied for the site. Immaterial whether the loss or damage results from negligence or otherwise.

The entire liability of MWebsAtWork to the Client in respect of any claim whatsoever or breach of this Agreement, whether or not arising out of negligence, shall be limited to the charges paid for the Services under this Agreement in respect of which the breach has arisen.
